Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Saleselite Consulting Group FZCO ("Company," "we," "us," or "our"). GrowthzillaOS® is a brand operated by the Company. These Terms govern your access to and use of the GrowthzillaOS® platform, the website at growthzilla.ae, APIs, integrations, and all related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Eligibility

  • You must be at least 18 years of age to use the Service.
  • You must provide accurate, current, and complete registration information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You may not use the Service if you have been previously banned or removed by us.
  • The Service is intended for business and professional use. Personal, non-commercial use is permitted but not the primary purpose of the platform.

3. Account Registration & Security

  • You must register for an account to access the Service. You may register using email/password or through Google Single Sign-On (SSO).
  • You are solely responsible for all activity under your account, whether or not authorized by you.
  • You agree to notify us immediately of any unauthorized use of your account at [email protected].
  • We reserve the right to suspend or terminate accounts that we reasonably believe are compromised or being used in violation of these Terms.
  • Multi-user access through agency workspaces is governed by the agency owner's subscription and the permissions they grant to team members.

4. Description of Service

GrowthzillaOS® is an AI-powered marketing operating system that provides:

  • AI Marketing Agents: Five specialized AI agents (The Writer, The Planner, The Researcher, The Tracker, The Chief) that generate content, strategies, analytics, and recommendations.
  • Content Generation: AI-assisted creation of social media posts, blog content, email sequences, ad campaigns, lead magnets, and brand voice guidelines.
  • Lead Management: Landing page creation, lead capture forms, lead scoring, CRM-lite functionality, and email outreach automation.
  • Reputation Management: Review monitoring, AI-powered reply generation, review campaigns, and reputation scoring.
  • Analytics & Intelligence: Market research, competitor analysis, trend identification, performance tracking, and AI-driven insights.
  • Integrations: Connections to third-party platforms (Google, LinkedIn, Meta, Telegram, WhatsApp, and others) for publishing and notification delivery.
  • Agency Features: White-label workspaces, client management, team collaboration, branded portals, and bulk operations.
  • Accountability Tools: Goal tracking, milestone management, AI coaching via Telegram bot, and progress check-ins.

5. Subscription Plans & Billing

5.1 Plans

The Service is offered through tiered subscription plans (Launch, Growth, Scale) plus a limited free tier. Each plan includes a monthly allocation of AI tokens, lead capacity, and feature access as described on our pricing page.

5.2 Free Trial

New subscribers to paid plans receive a 3-day free trial. During the trial, you have full access to the selected plan's features. Your payment method will be charged at the end of the trial period unless you cancel before the trial ends. Cancellation during the trial will not result in any charges.

5.3 Billing

  • All paid subscriptions are billed on a recurring monthly basis via Stripe.
  • Prices are listed in USD and are exclusive of applicable taxes.
  • You authorize us to charge your payment method on file for recurring subscription fees and any additional purchases (e.g., token packs).
  • If payment fails, we will attempt to retry. After repeated failures, your account may be downgraded to the free tier.

5.4 Token Usage & Auto-Recharge

  • AI operations consume tokens from your monthly allocation. Different operations consume varying amounts of tokens based on complexity.
  • Unused tokens do not roll over to the next billing cycle.
  • You may purchase additional token packs at any time. Token packs are non-refundable once purchased.
  • If enabled, auto-recharge will automatically purchase additional tokens when your balance falls below a threshold you configure.

5.5 Cancellation & Refunds

  • You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
  • 3-day free trial: Every plan begins with a 3-day free trial. Cancel any time before the trial ends and you will not be charged.
  • 14-day money-back guarantee (usage-based): After your trial converts, you may request a full refund of your subscription fee within 14 days of your first payment, conditional on documented usage of the platform: a completed strategy conversation and at least one published piece of content. This is verified via your account dashboard. Tokens consumed during this period are non-refundable.
  • Outside of the guarantee window described above, no prorated refunds are provided for partial months of service.
  • Refund requests should be submitted to [email protected] and will be processed within 30 days.
  • Upon cancellation, your data will be retained for 90 days. After that period, all account data will be permanently deleted unless you request earlier deletion.

6. Acceptable Use Policy

You agree not to use the Service to:

  • Generate, store, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Send unsolicited commercial communications (spam) through our email or messaging features.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
  • Violate any applicable local, state, national, or international law or regulation, including anti-spam laws (CAN-SPAM, GDPR, CASL, etc.).
  • Interfere with, disrupt, or overload the Service, its servers, or connected networks.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems.
  • Use automated scripts, bots, scrapers, or similar tools to access the Service (other than through our official APIs).
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Resell, sublicense, or redistribute the Service or any AI-generated outputs without authorization (agency white-label features are exempted where included in your plan).
  • Use the Service to generate content that promotes violence, discrimination, or hatred against individuals or groups.
  • Submit false lead data, manipulate lead scoring, or engage in click fraud on landing pages.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its design, code, features, documentation, branding, logos, and AI models, is owned by Saleselite Consulting Group FZCO and protected by copyright, trademark, and other intellectual property laws. "GrowthzillaOS" and the GrowthzillaOS® logo are registered trademarks of Saleselite Consulting Group FZCO.

7.2 Your Content

You retain ownership of all content you create, upload, or input into the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive, worldwide license to process, store, and display Your Content solely for the purpose of providing and improving the Service.

7.3 AI-Generated Content

  • You own all AI-generated content produced through your account, subject to the following conditions:
  • AI-generated content is provided "as is" and may require your review and editing before use.
  • We do not guarantee that AI-generated content is original, accurate, or free from errors. You are responsible for verifying all content before publication.
  • We do not guarantee that AI-generated content does not infringe on third-party intellectual property rights. You are responsible for ensuring compliance.
  • Similar or identical content may be generated for different users due to the nature of AI language models.

7.4 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation or compensation to you.

8. Third-Party Integrations

  • The Service may integrate with third-party platforms (Google, LinkedIn, Meta, Telegram, WhatsApp, Stripe, and others).
  • Your use of these integrations is subject to the respective third party's terms of service and privacy policies.
  • We are not responsible for the availability, accuracy, or reliability of third-party services.
  • You are responsible for complying with each platform's terms when publishing content or conducting outreach through our integrations.
  • We may suspend or remove integrations at any time due to changes in third-party APIs, terms, or availability.

9. Data Processing & AI

  • Your business data is processed by AI language models to generate marketing content, strategies, and recommendations.
  • Data sent to AI providers is processed under data processing agreements and is not used to train third-party AI models.
  • AI outputs may occasionally contain inaccuracies, hallucinations, or biased content. You are solely responsible for reviewing and approving all AI-generated content before use.
  • We do not guarantee specific marketing results, lead generation volumes, conversion rates, or revenue outcomes from using AI-generated content or strategies.

10. Email & Messaging Compliance

  • You agree to comply with all applicable email marketing laws (CAN-SPAM Act, GDPR, CASL, UAE anti-spam regulations) when using our email sequence and outreach features.
  • You must only send emails to recipients who have given valid consent or with whom you have a legitimate business relationship.
  • All marketing emails sent through the Service must include accurate sender information and a functional unsubscribe mechanism.
  • You must not use the Service to send phishing emails, malware, or deceptive content.
  • Similarly, Telegram and WhatsApp messaging must comply with Meta's and Telegram's respective policies.

11. Landing Pages & Lead Capture

  • Landing pages created through the Service are hosted on our infrastructure and accessible via unique URLs.
  • You are responsible for the accuracy and legality of all content displayed on your landing pages.
  • Lead capture forms must include appropriate consent mechanisms (checkboxes, privacy notices) as required by applicable law.
  • We implement rate limiting and deduplication to protect against spam submissions, but cannot guarantee the quality or validity of all captured leads.
  • Lead data is stored in your account and is subject to our data retention policies.

12. Agency & White-Label Terms

  • Agency features (available on Scale plan and above) allow you to manage multiple client workspaces, apply custom branding, and invite team members.
  • As an agency owner, you are responsible for your clients' compliance with these Terms.
  • White-label branding (custom logo, colors, domain) does not transfer ownership of the underlying Service or technology.
  • Client data across workspaces is segregated. Agency owners have access to workspace-level analytics but not individual user credentials.
  • Team members invited to your agency workspace are bound by these Terms through their acceptance upon account creation.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

  • The Service will be uninterrupted, secure, or error-free.
  • AI-generated content will be accurate, complete, original, or suitable for your purposes.
  • The Service will meet your specific marketing goals or revenue targets.
  • Any defects in the Service will be corrected in a timely manner.
  • Third-party integrations will remain available or function as expected.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SALESELITE CONSULTING GROUP FZCO, THE OPERATOR OF THE GROWTHZILLAOS® BRAND, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

  • Your use of or inability to use the Service.
  • Any AI-generated content or recommendations.
  • Unauthorized access to or alteration of your data.
  • Errors, inaccuracies, or omissions in the Service.
  • Any third-party conduct or content accessed through the Service.

THE TOTAL AGGREGATE LIABILITY OF SALESELITE CONSULTING GROUP FZCO FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

15. Indemnification

You agree to indemnify, defend, and hold harmless Saleselite Consulting Group FZCO, the operator of the GrowthzillaOS® brand, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service.
  • Your Content or any content you publish through the Service.
  • Your violation of these Terms or any applicable law.
  • Your violation of any third-party rights, including intellectual property rights.
  • Any claim that content generated through your account caused harm to a third party.

16. Termination

  • By You: You may terminate your account at any time through your account settings or by contacting [email protected].
  • By Us: We may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent activity, or if required by law.
  • Effect of Termination: Upon termination, your right to use the Service ceases immediately. Your data will be retained for 90 days (unless you request immediate deletion), after which it will be permanently deleted.
  • Survival: Sections relating to intellectual property, limitation of liability, indemnification, governing law, and dispute resolution survive termination.

17. Governing Law & Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates.
  • Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation between the parties for a period of 30 days.
  • If negotiation fails, disputes shall be resolved through binding arbitration in Dubai, UAE, in accordance with the rules of the Dubai International Arbitration Centre (DIAC).
  • Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights.
  • You waive any right to participate in class action lawsuits or class-wide arbitration against us.

18. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to your registered address and/or through a prominent notice within the Service at least 14 days before they take effect.

Your continued use of the Service after the effective date of modified Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must stop using the Service and close your account.

19. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Saleselite Consulting Group FZCO regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • Force Majeure: We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, strikes, government actions, or failures of third-party services.
  • Notices: All legal notices to us should be sent to [email protected]. We may send notices to the email address associated with your account.
